Getting a Divorce in New Jersey

Many people are unaware that New Jersey is a no-fault divorce state. This means that you may state irreconcilable differences as your reason for divorce. The old rule that required an 18-month separation prior to no-fault divorce no longer applies.

It can take up to a year to finalize a divorce, depending on how quickly the parties are able to reach an agreement. The state of New Jersey tries to resolve cases within one year. If a divorce is contested, the couple will attend a settlement panel to attempt to reach an agreement. If that is unsuccessful, they will attend economic mediation. Uncontested divorces generally take less time to finalize.
