Child Custody and Parenting Time

In New Jersey, custody and visitation (parenting time) are determined by what is in the best interest of the child. There is no automatic preference for mothers over fathers. Sole or joint custody may be granted based on the child's needs. Many times, joint legal custody is granted, which allows each party to have input into major decisions. Usually, one parent will be the primary custodian (the person with whom the child lives the majority of the time) and one will be the parent of alternate residence.
