Determining Alimony in New Jersey
Alimony can be granted to either a husband or wife for a number of reasons. In general, people qualify for alimony based on their age, their capacity to earn, the disparity in income between the parties and the length of the marriage. There are exceptions and special circumstances, however.
In New Jersey, alimony usually takes one of these forms:
- Limited-term (temporary) — Payments are made for a fixed period of time during the divorce process.
- Permanent — Payments continue indefinitely until the recipient or payer passes away or there is a change in circumstances such as retirement or disability of the payer.
- Rehabilitative — Payments continue until the recipient is able to support him or herself.
